Notes for Trial

1/6/02

1)    Submit the Police Report as Evidence.

2)    The police report states “The child was literally caught in a tug of war between the defendant and the day care staff. This was done maliciously and wantonly against the victim’s will.”

A)    Yet during the interrogation of the child by Rae Weir of the Department of Children and Families, and the Police, it is stated that “Stephin also stated that he ran to the car; opened the door, got in and locked the door.”

3)    The State has represented to the court that it has sheltered the children starting August 1, 2001 and is protecting them; yet, it does not know, and have not know for months where the children live.

A)    The State does not know, because the mother has taken her children into hiding, because she knows that the goal of the State is not to protect the children, but to take them away from her and her son’s father.

B)    Of course, being a poor black woman, she cannot understand why. She cannot understand that she and her children are still slaves; that they are not free, but owned by certain white folks like Rae Weir who us their governmental positions to enforce their ownership of niggers in a country of make believe freedom.

4)    The police report states:

A)    “When Danago grabbed Stephin by the arm and headed for the door, Williams and Santiago blocked his path.

B)    “Danago struck Williams in the head with his fist. Santiago grabbed Danago and Danago kicked Williams in the side knocking her to the ground.

a)    What were the men doing while all of this was going on, and why did they not defend the ladies?

C)   “It was later learned that Santiago fractured her right arm in the altercation.”

a)    How was the arm hurt?

D)   Fredick Schmid, Luis Deleon and Eric Dutt wrestled with Danago.

a)    How is it that none of you were hurt, and how did the 3 of you hurt Danago?

E)    “Danago did not know that he wasn’t on the release list and Stephin had come home with injuries a couple of times from the daycare.”

a)    “He stated that it would be negligent for him to leave his son in an abusive situation so he wet to leave.

F)    “The initial report that I was given advised that Danago gave his son the injury to his lower lip when Danago threw his son through the open window.”

G)   Prior to Cooks leaving the scene, one daycare employee told her that Danago inflicted the injury to Stephin’s lip and when Stephin advised that the injury occurred earlier in the day, the staff denied it.

H)   During the interrogation by Rea Weir:

a)    “Stephin also advised that he cut his lip on the porch at the daycare center when a child pushed him down and that the child was given a time out. Stephin also stated that he ran to the car; opened the door, got in and locked the door.

5)    Director Williams:

A)    Testified that the file showed that no one other than the mother was to remove the child.

a)    She also testified that the file specifically stated that I, Stephen Danago, was not to remove the child.

b)    Her statement to the police was that she did not know that Stephin had a father.

1.     So, how and why would that file specifically state that I, not be allowed to remove my son?

B)    Stated to the police that I grabbed Stephin by the arm and headed for the door, and she and Santiago blocked my path.

a)    Yet, she testified that I climbed over her desk and punched her on the right side of her face.

b)    Then, testified that I went around the desk and punched her on the right side of her face.

c)     And, still later, testified that I leaned over the desk and punched her on the right sid of her face.

d)    Testified that after we went outside, I punched her in her left eye.

C)   Stated in the police report that I threw Stephin through the window of the car.

1.     But, testified that Stephin ran to the car and locked himself in.

6)    Santiago:

A)    Testified that I gave her my driver’s license outside.

B)    Testified that a male staff member, ________________, was in the office during the time of the alleged incidence.

7)    Stephin:

A)    A 4 year old child, can be taken into a closed door interrogation by the police and a professional interrogator of the Department of Children and Families to gain evidence to convict his father on trumped up charges, but he can’t be questioned by the police officer at the alleged crime scene about what just happened; when, what just happened is to be used to take his father away from him.

B)    Questions:

a)    What happened at the day care center when I came to put the medicine in your eyes?

b)    Have you ever seen me get made and throw anything?
